Abstract

El Tribunal Constitucional español ha emitido numerosas sentencias de alto valor técnico; ha establecido, por ejemplo, conceptos básicos como los de igualdad de trato (discriminaciones directas e indirectas) e igualdad de oportunidades; sin embargo, no siempre ha utilizado tales conceptos de modo teóricamente preciso. El presente trabajo examina críticamente, hasta 2010, toda la jurisprudencia del Tribunal Constitucional sobre la prohibición constitucional de discriminación por razón de género.; The Spanish Constitutional Court has issued numerous judgments of high technical merit. It has established, for example, the basic concepts, such as equality of treatment (direct and indirect discrimination) and equal opportunities.However, the Court has not always used such theoretical concepts more precise. This paper critically examines all the jurisprudence of the Constitutional Court on the constitutional prohibition of discrimination based on gender (until 2010).
