PERLINDUNGAN HUKUM BAGI PEMILIK KENDARAAN ATAS PELANGGARAN LALU LINTAS BERBASIS TILANG ELEKTRONIK

Abstract

The problem of indiscipline and disobedience of drivers is still a problem faced by law enforcement officers in Indonesia. The birth of the E-Speeding ticket (Electronic Ticket) is a complementary effort in overcoming the problem of traffic order violations, so that its position does not eliminate the conventional way of direct traffic regulation. With the enactment of the Electronic Ticket, it is hoped that it can provide a faster and more effective service so that it can provide convenience in the context of resolving traffic violations. The legal issue regarding electronic tickets is the focus of discussion regarding who should be responsible for traffic violations. The contemporary paradigm views that the owner of the vehicle must be responsible for traffic violations regardless of whether the owner of the vehicle is the violator in question or not. The writing of this article does not discuss the responsibility for vehicle owners who are also traffic violators, but discusses vehicle owners who are not traffic violators but must still be responsible for traffic violations. This study uses a statutory approach and a conceptual approach. The results of this article prove that the violator should be responsible for traffic violations (regardless of whether the violator is also the owner of the vehicle or not). Vehicle owners who do not commit traffic violations should not be penalized (electronic fines).
