Eficacia

Abstract

The notion of ‘effectiveness’ of the law refers to a set of core phenomena that characterize a polity in which legality is the main focus of social integration. However, it is not a simple notion. In spite of their intuitive relationship, ‘effectiveness’ cannot be reduced to “compliance”. The relationship between these two dimensions of the legal system depends on a number of previous methodological options, which are to be specified. Furthermore, it worth be noticed that this issue becomes crucial in our times, because of the radical and accelerated mutation in the structure of legal forms.La noción de ‘eficacia del Derecho’ alude a un conjunto de fenómenos centrales en comunidad política donde la ley es el eje sobre el que se articulan los procesos de integración social. No se trata, sin embargo, de una noción unívoca. A pesar del nexo intuitivo, ‘eficacia’ no equivale a ‘cumplimiento’. Por el contrario, la relación estas dos dimensiones del sistema jurídico depende de una serie de opciones metodológicas previas, que conviene precisar. La cuestión resulta especialmente interesante en una fase histórica como aquella en la que nos encontramos, en la que asistimos a una intensa y acelerada mutación en la estructura de las formas legales.
