Abstract

This article focused on the shortening iddah period for pregnant divorced women by doing abortion. Basically the iddah period for a pregnant woman is until she gives birth to a child in her womb. This research uses a normative juridical approach with legal comparisons, descriptive and qualitative analysis. Data collection techniques are carried out by tracing the legislation and other legal sources of the legal system that are considered relevant to abortion by pregnant women to speed up their ‘iddah. This paper argues that the abortion is harshly prohibited by Indonesian and Islamic Law. If a pregnant divorced woman doing abortion in her iddah period to be married by a man, her marriage is null and void.
