Abstract

Neste trabalho, buscou-se analisar a importancia da Topica de Cicero para a teoria da argumentacao juridica de Theodor Viehweg. A topica aristotelica, formulada com o intuito de compor o sistema filosofico de Aristoteles com um estudo acerca da natureza do conhecimento dialetico, diferencia-se da topica de Cicero, escrita com o fim de descrever o metodo da topica e de enumerar tecnicas uteis a pratica juridica romana. Ao separar a topica ciceroniana da aristotelica, foi possivel comentar sobre o papel de cada um desses textos na obra de Viehweg e analisar mais a fundo as caracteristicas particulares de cada um deles e a influencia da topica ao longo da Historia. Palavras-chave: Cicero. Topica. Teoria da Argumentacao. The objective in this work was to analyze the importance of Cicero's Topics on Theodor Viehweg's legal argumentation theory. Aristotle's Topics, intending to integrate his philosophical system with a study on the nature of dialectical knowledge, is different from Cicero's Topics, which was written to describe the use of the topics and to draw up a list of useful techniques to Roman jurisprudence. Separating the ciceronian from the aristotelic Topica, we could comment about the role of each of the texts in Viehweg's work and analyze in a deeper way the particular features of each one of the Topica and the way those texts influenced History.
