Abstract

El presente artículo aborda la figura de la terminación anticipada en el proceso penal peruano como un mecanismo que busca reducir la sobrecarga judicial y agilizar la administración de justicia. No obstante, su aplicación plantea un dilema frente a los derechos fundamentales del imputado, especialmente el derecho de defensa, la presunción de inocencia y el principio de legalidad; es por ello que el objetivo de la investigación es analizar críticamente la tensión entre la eficiencia procesal y las garantías constitucionales que se ven comprometidas en este procedimiento. Para ello, se empleó una metodología cualitativa sustentada en el análisis documental, recurriendo a jurisprudencia nacional y comparada, así como a aportes doctrinarios relevantes; Podemos observar que los resultados evidencian que, aunque la terminación anticipada puede ser una herramienta útil, su legitimidad depende de un consentimiento libre e informado, la proporcionalidad de la sanción y un adecuado control judicial; en conclusión, su fortalecimiento exige equilibrar la celeridad procesal con la garantía plena de los derechos fundamentales, en coherencia con el Estado constitucional de derecho.This article addresses the figure of plea bargaining (early termination) in the Peruvian criminal process as a mechanism intended to reduce court congestion and expedite the administration of justice. However, its application raises a dilemma regarding the fundamental rights of the defendant, especially the right to defense, the presumption of innocence, and the principle of legality. The objective of the study, therefore, is to critically analyze the tension between procedural efficiency and the constitutional guarantees that may be affected in this procedure. A qualitative methodology based on documentary analysis was used, drawing on national and comparative case law, as well as relevant doctrinal contributions. The findings show that although plea bargaining can be a useful tool, its legitimacy depends on the defendant’s free and informed consent, the proportionality of the sanction, and adequate judicial oversight. In conclusion, strengthening this mechanism requires balancing procedural speed with the full protection of fundamental rights, in coherence with the constitutional rule of law.
