Abstract

The global pandemic of COVID-19 is caused by severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2). The outbreak was initially detected in mid-December 2019 in Wuhan City, Hubei China and was recognized as a pandemic by the World Health Organization (WHO) on March 11, 2020. In general, the COVID-19 pandemic can be fatal to its sufferers and date, physicians have not yet found a drug or treatment specifically for COVID-19. However, so far, the issues related to hibah for the case of maradh al-mawt for COVID-19 patients has not been discussed as it has just hit the world today. This study discussed the concept of COVID-19 pandemic according to clinical as well as from the perspective of fiqh. In addition, a discussion was made on the concept of maradh al-mawt according to current fiqh and legislation. An explanation had been made on the status of COVID-19 sufferers in the terminal disease category or maradh al-mawt according to fiqh, followed by several cases that have been reported regarding maradh al-mawt. Finally, the study has touched on the effect of hibah to a COVID-19 patient if the patient had reached the critical level. As a result, a hibah prepared by a COVID-19 patient, can be categorized as a maradh al-mawt hibah if the physician has classified the patient’s current condition has reached a critical stage.
