Efectividad del derecho humano a la salud a través del juicio de amparo

Abstract

Objective: Analyze the effectiveness of the right to health through the amparo trial. Materials and methods: The study methodology focuses on a qualitative analysis of judicial decisions related to the right to health in Mexico, integrating interdisciplinary approaches that include the complex perspective of the right to health. It evaluates how the interpretation of the Federal Judiciary has been guaranteeing since the 90s, even before the Constitutional Reform of Human Rights of 2011, for which cases will be considered where acts of inequality were notorious. The investigation also resorts to strategic litigation through injunctions, providing empirical experiences for analysis and establishing precedents in the matter. Results: The protection of the right to health has been evolving over the years, it is clear to see the progressivity in this right; Inequality, poverty and bureaucracy are the product of inefficient public policy, however, the Judiciary has been an instrument for the direct justiciability of human rights in complex situations, in this case, the right to health. Conclusions: The amparo trial in Mexico has transcended its programmatic role to become a key instrument of the Judiciary in the effective protection of the right to health since the 1990s, making up for the deficiencies of public policies and leading advances in issues such as discrimination and access to medical treatments. The Constitutional Reform of 2011 has reinforced this mechanism, facilitating social justice in the face of inequalities in access to health, and pointing the way towards a more comprehensive understanding of human rights that goes beyond the letter of the law.   Keyword: Human right; Medical coverage; Civil rights.Objetivo: Analizar la efectividad del derecho a la salud a través del juicio de amparo. Materiales y métodos: La metodología del estudio se centra en un análisis cualitativo de las decisiones judiciales relacionadas con el derecho a la salud en México, integrando enfoques interdisciplinarios que incluyen la perspectiva compleja del derecho a la salud. Se evalúa cómo la interpretación del Poder Judicial Federal ha sido garantista desde los años 90, incluso antes de la Reforma Constitucional de Derechos Humanos de 2011, para lo cual, se consideraron casos donde fueran notorios hechos de desigualdad. La investigación también recurre al litigio estratégico a través de amparos interpuestos, proporcionando experiencias empíricas para el análisis y estableciendo precedentes en la materia. Resultados: La protección del derecho a la salud ha ido evolucionado con el pasar de los años, es claro ver la progresividad en este derecho; la desigualdad, la pobreza y la burocracia son producto de una ineficiente política pública, sin embargo, el Poder Judicial ha sido un instrumento para la justiciabilidad directa de los derechos humanos ante situaciones complejas, en este caso, del derecho a la salud. Conclusiones: El juicio de amparo en México ha trascendido su rol programático, para convertirse en un instrumento clave del Poder Judicial en la protección efectiva del derecho a la salud desde los años 90, supliendo las deficiencias de las políticas públicas y liderando avances en temas como la discriminación y el acceso a tratamientos médicos. La Reforma Constitucional de 2011 ha reforzado este mecanismo, facilitando la justicia social frente a las desigualdades en el acceso a la salud, y señalando el camino hacia un entendimiento más integral de los derechos humanos que va más allá de la letra de la ley.   Palabra clave: Derecho humano; Cobertura médica; Derechos civiles.
