EL DERECHO A LA SEGURIDAD SOCIAL EN EL CONSTITUCIONALISMO CHILENO: UN CONTINENTE EN BUSCA DE SU CONTENIDO

Abstract

Resumen: Este artículo analiza el contenido variable del derecho constitucional a la seguridad social en el constitucionalismo chileno, basado en antecedentes históricos, doctrinales y, en menor medida, juris-prudenciales, ofreciendo, a la vez, una visión retrospectiva y prospectiva sobre el desarrollo constitucional en la materia. El artículo sostiene que existen actualmente desarrollos doctrinales y jurisprudenciales que permiten avizorar una expansión eventual del contenido normativo del citado derecho, por lo que este último constituye actualmente un continente en busca de su contenido. AbstRAct: This article analyzes the varying content of the constitutional right to social security in Chilean constitutionalism based on the existing literature, historical materials, and, to a lesser extent, judicial decisions, offering thus a view both retrospective and prospective about the Chilean constitutional development thereof. It maintains that an expansion of the normative content of this constitutional right may eventually take place, after factoring in new developments in the literature and the courts; therefore, this constitutional right is better conceived today as a continent that searches for content.
