SOBRE EL LUCRO CESANTE

Abstract

Based on fundamental premises and based on certain illustrative cases, this paper discusses the loss of profit from its concept to its essential characteristics, focusing its analysis from its economic dimension, the requirement of certainty in its determination, the conceptual conflict that it generates and the abstraction that it requires; its reception in the various legal texts of contemporary Civil Law, and finally, its relationship with other areas of patrimonial law: unjust enrichment and free competition, respectively.
