Abstract

O presente estudo visa analisar a responsabilidade civil decorrente do abandono afetivo parental, explorando seu papel na legislação e na prática jurídica contemporânea. Abordar-se-á como o direito de família interpreta a falta de afeto e cuidado dos pais em relação aos seus filhos e as consequências jurídicas dessa negligência. Para tanto, utilizar-se-á a metodologia de pesquisa bibliográfica, revisando literatura especializada, legislação pertinente e julgados relevantes que discutem e delineiam os contornos da responsabilidade civil por abandono afetivo. A justificativa para a escolha do tema reside na relevância social e jurídica que o abandono afetivo assume nas relações familiares contemporâneas. As consequências do abandono afetivo são profundas e podem afetar significativamente o desenvolvimento emocional e psicológico das crianças. A análise deste tema é crucial para entender até que ponto o ordenamento jurídico pode e deve intervir em relações pessoais, buscando reparar danos morais causados por negligência afetiva. Esse estudo pretende contribuir para um melhor entendimento das implicações legais do abandono afetivo parental e estimular reflexões sobre possíveis melhorias na proteção jurídica das crianças e adolescentes, destacando a importância de uma legislação que efetivamente coíba e repare tais danos.The present study aims to analyze civil liability arising from parental emotional abandonment, exploring its role in contemporary legislation and legal practice. It will address how family law interprets parents' lack of affection and care towards their children and the legal consequences of this negligence. To this end, the bibliographical research methodology will be used, reviewing specialized literature, pertinent legislation and relevant judgments that discuss and outline the contours of civil liability for emotional abandonment. The justification for choosing the topic lies in the social and legal relevance that emotional abandonment assumes in contemporary family relationships. The consequences of emotional abandonment are profound and can significantly affect the emotional and psychological development of children. The analysis of this topic is crucial to understand the extent to which the legal system can and should intervene in personal relationships, seeking to repair moral damages caused by emotional negligence. This study aims to contribute to a better understanding of the legal implications of parental emotional abandonment and stimulate reflections on possible improvements in the legal protection of children and adolescents, highlighting the importance of legislation that effectively curbs and repairs such damage.
