Abstract

Max Weber and Hans Kelsen are two classical authors considered extremely important in the creation of some of the essential concepts that are commonly used in the Social Sciencs and Law, respectively. However, when these two fields of knowledge are put together under the rubric of the Sociology of Law, a series of misunderstandings around terminology, objects and methods tend to emerge, making it difficult to attain desired levels of scientific rigor. In this light, the present article aims to establish some of the most important distinctions that need to be made between the Sociology of Law and Jurisprudence, as they are represented by the works of the two above-mentioned theorists. © 2007 Revista de Sociologia e Política.
