PERAN PEJABAT PEMBUAT AKTA TANAH DALAM ADMINISTRASI PERTANAHAN MELALUI SERTIPIKAT TANAH ELEKTRONIK

Abstract

Abstrak Tujuan studi ini ialah untuk mengkaji peran PPAT dalam rangka penyelenggaraan administrasi Pertanahan melalui Sertipikat Elektronik, esensi kepemilikan atas tanah, kondisi sistem administrasi pertanahan nasional, dan urgensi sertipikat tanah elektronik dalam memecahkan problematika sengketa pertanahan di Indonesia. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil studi menunjukkan bahwa hak atas tanah merpakan hak ekonomi yang harus dilindungi, dipenuhi, dan dihormati oleh negara. Di sisi lain, upaya pemerintah belum dapat menangani ketidakpastian hukum dalam sistem administrasi pertanahan di Indonesia. Dalam perspektif hukum pertanahan, sertipikat tanah elektronik dapat menjadi upaya penyelesaian sengketa pertanahan. Kata Kunci: Sertipikat Tanah Elektronik, Kepastian Hukum, Administrasi Pertanahan, PPAT. Abstract The purpose of this study is to examine the essence of reviewing the role of PPAT in the context of administering land administration through Electronic Certificates, land ownership, the condition of the national land administration system, and the urgency of electronic land certificates in solving land disputes in Indonesia. This study uses a normative legal research method with a statutory and conceptual approach. The results of the study show that land rights are economic rights that must be protected, fulfilled, and respected by the state. On the other hand, the government's efforts have not been able to deal with legal uncertainty in the land administration system in Indonesia. In the perspective of land law, electronic land certificates can be an effort to resolve land disputes. Keywords: Electronic Land Certificate, Legal Certainty, Land Administration, PPAT.
