Abstract

Law and State are two things that need each other as well as complement each other. The state can be seen as a unit that has political juridical construction. Law only exists or manifests itself in a social group, one of which is the state, and the state cannot operate sustainably without the existence of legal elements that protect its existence. This research focuses on the legal position as a determinant factor in the formation of an independent and sovereign state and how the legal position is in the perspective of a modern (legal) state. In this case the law does not only function as a guardian of order (law in order). But besides that the most essential legal function in the context of the modern state (law) is how the law can develop the welfare of the people in the life of the statehood.
