Abstract

Climate change in Indonesia has increased substantially, regarding the rising number of lawsuits and decisions on climate change litigation and decisions. Mention to litigation practices of climate change, after was filtered/sorted also identification of issues/motivations, then climate change litigation encompasses kind of litigation with climate change as one motivation, and litigation with no specific climate change framing but with implications for mitigation or adaptation. The purpose of this paper is to analyze unlawful acts that are committed by perpetrators, based on doctrines of fault, negligence, strict liability, and factual action. This research can provide advocacy options for climate change policy through litigation in court for justice seekers.
