Vicisitudes del derecho fundamental a la salud en Colombia período 2020-2021 su enfoque y las incidencias en su limitación

Abstract

En Colombia es frecuente que, en las prácticas de la atención en salud, la fundamentalidad del derecho a la salud experimente afectaciones con importantes consecuencias sociales asociadas, de allí que, en coherencia con lo manifestado, el objetivo de este trabajo investigativo sea evidenciar las vicisitudes del derecho fundamental a la salud en Colombia derivadas de la declaratoria del Estado de Excepción por Emergencia Económica, Social y Ecológica (EEEESE), las declaratorias de Emergencia Sanitaria (ES) y las Alertas Rojas Hospitalarias (ARH) a que obligó la pandemia del COVID-19 en el período 2020-2021. En adherencia con lo planteado este desarrollo investigativo implicará una metodología que, a apuntalada en el proceder hermenéutico, en razón, a la esencia interpretativa de las fuentes que lo sustentan, posibilite un análisis crítico-argumentativo de documentos de índole jurisprudencial devenidas de los archivos del Congreso y la Corte Constitucional, normativa de los entes gubernamentales involucrados en el manejo de la pandemia, además de textos jurídicos y filosóficos contentivos de desarrollos relacionados con el objeto de este escrito de tal manera que, transversalizados con el informe de “El estado de los derechos en estado de emergencia” de la Procuraduría General de la nación, permitan evidenciar los sucesos que fueron adversos a la idea de fundamentalidad que acompaña al derecho a la salud materializadas en actuaciones de índole jurídica por parte de los distintos operadores que desde el nivel nacional o territorial plantean una dicotomía entre un Estado garante de la salud como derecho fundamental y un Estado donde esa garantía admite, circunstancialmente el epíteto de “mera lírica constitucional” en los términos a los que, en sus tesis, hace referencia Alexy.In Colombia it is frequent that, in the practices of health care, the fundamentality of the right to health experiences affectations with important associated social consequences, hence, in coherence with what has been stated, the objective of this investigative work is to demonstrate the vicissitudes of the fundamental right to health in Colombia derived from the declaration of the State of Exception due to an Economic, Social and Ecological Emergency (EEEESE), the declarations of Health Emergency (ES) and the Hospital Red Alerts (ARH) that the COVID pandemic forced -19 in the period 2020-2021. In adherence to what has been stated, this investigative development will imply a methodology that, propped up in the hermeneutical procedure, due to the interpretative essence of the sources that support it, enables a critical-argumentative analysis of documents of a jurisprudential nature from the archives of the Congress and the Constitutional Court, regulations of the government entities involved in the management of the pandemic, in addition to legal and philosophical texts containing developments related to the purpose of this writing in such a way that, transversalized with the report "The state of the rights in a state of emergency" of the Office of the Attorney General of the nation, allow to demonstrate the events that were adverse to the idea of ​​fundamentality that accompanies the right to health materialized in actions of a legal nature by the different operators that from the national level or territorial pose a dichotomy between a state that guarantees health as a fundamental right and a State where this guarantee circumstantially admits the epithet of "mere constitutional lyric" in the terms to which Alexy refers in his theses.
