Abstract

this paper tackles the key factors for a complex oversight dynamic between Independent Regulatory Agencies and Federal Court of Accounts, mainly the fact that both of them were strangers to the Constitution drafters. Therefore, the named “outlier oversight” is the main study object, considering scholars discussion as well as empirical studies which provide a practical perception of these dynamics. In the end, the paper presents alternatives for reconstruction of the Federal Court of Accounts’ oversight of Independent Regulatory Agencies for more rationality and legal certainty.
