Abstract
Indonesia is a country that is committed to fulfill the right to education for its citizens, including for children of the sea tribe. The right to education has been regulated in the 1945 Constitution and Law Number 20 of 2003 concerning the National Education System, Government Regulation No. 47 of 2008 concerning Compulsory Education. Lingga Regency is one of the areas in the Riau Islands Province which is still surrounded by marine tribal communities. Kelumu Island is one of the islands in Lingga Regency which is still inhabited by tribal marine communities. The marine tribal community is the indigenous people in Lingga Regency. The purpose of this study was to analyze the fulfillment of the right to education for children of the sea tribe on Kelumu Island, Lingga Regency. The research method used in this research is empirical juridical and uses Legal Effectiveness Theory by Soerjono Soekanto. The results of this study indicate that the fulfillment of the right to education for children of the sea tribe on Kelumu Island, Lingga Regency is still not effective when measured by the Legal Effectiveness Theory, due to the lack of infrastructure factors, namely the limited availability of schools, the community, and the culture that carries out child marriages to make the child drop out of school. Therefore, the recommendations are to create job opportunities for marine tribal communities, build schools at the junior high and high school levels located in the Kelumu Island area.
