Abstract

O desempenho sustentável da função regulatória é imperativo. As recentes crises econômico-financeiras e ambientais só têm mostrado a importância de encontrar a medida certa de intervenção estatal na arena do mercado para induzir o desenvolvimento sustentável. Neste artigo, apresentam-se as condições para uma teoria da regulação compatível com o princípio da sustentabilidade, especialmente para superar as falhas de mercado e de governo. Theory of sustainable administrative regulation The sustainable performance of the regulatory function is imperative. The recent economic-financial and environmental crises have only shown the importance of finding the right measure of state intervention in the market arena to induce sustainable development. In this article, the conditions are presented for a theory of regulation compatible with the principle of sustainability, especially to overcome market failures and government failures.
