Penegakan Hukum Terhadap Pelanggaran Atas Kewenangan Dan Kewajiban Notaris Yang Tidak Diatur Dalam Undang-Undang Jabatan Notaris Oleh Majelis Pengawas Notaris

Abstract

Notary is a public official authorized to make authentic deeds. However in carrying out their duties, it is highly possible for a Notary to err and to violate their office duties. The Notary Supervisory Board carries out the supervisory and guidance functions of alleged violations committed by the Notary. The consequence of not optimal regulation regarding the mechanism for imposing legal sanctions on Notaries results in the emergence of legal uncertainty. The formulation of the problem in this study is whether the Notary Supervisory Board finds violations of the Notary's authority and obligations that have not been regulated in the Law on Notary Offices and how to apply the sanctions given by the Notary Supervisory Board for Notary violations of the authority and duties of their position that have not been regulated in the Law Concerning the Position of Notary Public. This is a normative legal research supported by empirical evidence that is carried out using a statutory approach and a conceptual approach. The results of the research and discussion show that the Notary Supervisory Board found various forms of violations of the Notary's obligations and authority. Notaries can be subject to various forms of sanctions, administrative responsibility, and civil penalties in accordance with legal norms. However, the forms of violations that occur in the field are not specifically regulated in the Law on Notary Offices or the Code of Ethics.
