Abstract

The rupture between liberalism and neoliberalism provides the background of the reflections on the relationship between law and freedom, if we understand liberalism as a doctrine that admits of a positive value of the use of law and neoliberalism as a doctrine that denies it (the fewer the rules, the better we live). Whichever way one looks at it, however, the relationship between law and freedom remains problematic, but above all plural: law can constrain but it can also liberate, indeed it often constricts and liberates at the same time.
