Abstract

Is the Latin American fideicomiso a trust? To answer this question the author explains what a trust is in Latin America, points out the differences with the Quebec model and based on the criteria set by Lewin and by the Hague Convention, provides a clear answer: yes, Latin American fideicomiso is a trust.
