Abstract

What is the legitimacy of the constitutional judge when it annuls a law approved by the representatives of the people? Can it play a role in preventing majority will? The article intends to demonstrate that the Constitution does not characterize an obstacle to democratic expression, but rather the condition of its enrichment and its deepening.
