The status of Brussels in the hypothesis of confederalism

Abstract

This article looks into the future of Brussels in the hypothesis of Belgium’s move towards confederalism. After defining this term and making a distinction between its legal and political usage, the authors explore various scenarios that could lead from federalism to confederalism, showing that the latter is not a mere continuation of the former and that the path is strewn with heady questions. They then review the statuses that could be envisaged for Brussels in the hypothetical wake of such a move, and call for an interdisciplinary and citizen-based reflection in reaction to their analyses.Cet article se penche sur le devenir de Bruxelles dans l’hypothèse d’un passage au confédéralisme. Après avoir défini ce terme en en distinguant les usages juridiques et les usages politiques, les auteurs explorent les différents scénarios pouvant mener du fédéralisme au confédéralisme, montrant que le second n’est pas la continuation du premier et que le chemin de l’un à l’autre est pavé de questions redoutables. Ils passent ensuite en revue les statuts envisageables pour Bruxelles dans l’hypothèse où ce passage au confédéralisme serait accompli, appelant de leurs voeux une réflexion interdisciplinaire et citoyenne en réaction à leurs analyses.Dit artikel buigt zich over de toekomst van Brussel ingeval de Belgische staat omgevormd wordt in een confederatie. Eerst geven de auteurs een definitie van de term ‘confederatie’, waarbij ze een onderscheid maken tussen het juridische gebruik en het politieke gebruik ervan. Vervolgens verkennen ze de verschillende scenario’s die van federalisme naar confederalisme kunnen leiden. Ze tonen daarbij aan dat het confederale model geen voortzetting van de federale structuur is en dat die overgang netelige kwesties aan de orde stelt. Daarna geven ze een overzicht van de mogelijke statuten voor Brussel ingeval België een confederale structuur zou krijgen. Tot slot formuleren ze de wens dat hun analyse de burgers en het maatschappelijk middenveld tot een interdisciplinaire reflectie aanzet.
