Abstract

In this divorce procedure the plaintiff asks for a shared custody or at least the right to visit their dog, in order to keep contact with the animal. The Judge recognizes that animals are living beings, but still considered personal property (in this case joint property), and that is how they should be claimed, through another specific legal procedure and not in this one. However, the sentence includes a particular vote by one the judges, who defends that the Court should have solved this issue as well.
