Abstract

This article analyzes the "control of conventionality" doctrine, by the national courts in the inter-American system for the protection of human rights, with particular reference to the argentine case, regarding the domestic receipt and acceptance. Later, it studies the application of this criterion in the European system for protecting human rights, in order to verify the existence of a similar practice to that which exists in the inter-American system. In closing, it reviews the application of the "control of conventionality" principle, in the Spanish legal order and, fundamentally, the enforcement of sentences of the European Court of Human Rights, is discussed.
