KEBIJAKAN FASILITASI HAK KEKAYAAN INTELEKTUAL OLEH BADAN EKONOMI KREATIF (BEKRAF) DALAM PENGUATAN UMUM BIDANG EKONOMI KREATIF

Abstract

Abstract This legal research describes whether Badan Ekonomi Kreatif , especially the Deputy of Intellectual Property Rights and Regulations, has run its program in facilitating Intellectual Property owned by creative economy performers in Indonesia. This research uses descriptive empirical legal research methods. The results of this research indicate that Bekraf has greatly assisted Creative Economic actors in obtaining legal protection over their products. The problem experienced by Bekraf is the lack of coordination between Bekraf and its partners, creative economy actors who put aside the importance of IPR, as well as communal products of Geographycal Indications that are contrary to IPR Principles. The Ministry of Tourism and Creative Economy hopefully hopefully can continue Bekraf’s Intellectual Property Facilitation and disseminating IPR on a periodic basics for the creative economy actors. Abstrak Penulisan hukum ini mengkaji apakah Badan Ekonomi Kreatif khususnya Deputi Fasilitasi Hak Kekayaan Intelektual dan Regulasi sudah menjalankan programnya dalam memfasilitasi Kekayaan Intelektual milik pelaku ekonomi kreatif di Indonesia. Penulisan ini menggunakan metode penelitian hukum empiris bersifat deskriptif. Hasil penelitian ini menunjukan bahwa Bekraf melalui programnya sudah membantu para pelaku ekonomi kreatif dalam memperoleh kekuatan hukum atas produk maupun ciptaannya. Hambatan yang dialami Bekraf berupa kurangnya koordinasi antara Bekraf dan mitra kerja, pelaku ekonomi kreatif yang mengesampingkan pentingnya Kekayaan Intelektual, serta produk komunal Indikasi Geografis yang bertentangan dengan prinsip HKI. Kementrian Pariwisata dan Ekonomi Kreatif diharapkan dapat melanjutkan program Bekraf dalam Fasilitasi Kekayaan Intelektual dan melakukan sosialisasi HKI secara periodik terhadap pelaku ekonomi kreatif.
