The Role of Respecting the Human Dignity of Criminals in Crime Prevention from the Perspective of Islamic Teachings

Abstract

Crime prevention has different methods and models, of which the dignity-based prevention model is one of them. Dignity-based prevention means that in the process of facing the crime, the character and inherent dignity of the criminal is taken into consideration. Prevention based on respect for the criminal's human personality is based on the assumption that people's social status has an effective role in committing or not committing a crime. The aim of the current research is to investigate the role of respect for the criminal's human personality in crime prevention from the perspective of Islamic teachings and to find a model of effective confrontation with the criminal phenomenon and its prevention. The current research seeks to provide an answer to the question of what respect the criminal's human personality has in Islamic teachings and what effect this approach has on crime prevention. The data of the current research has been collected through library studies and analyzed using the analytical-descriptive research method based on Islamic teachings and criminology. The findings of the research indicate that according to Islamic teachings, committing a crime does not create a disturbance in the inherent dignity of a human being, and this issue has Quranic, narrative and rational foundations, which include components such as emphasis on the concealment of some crimes, forgiveness and negligence in the actions of some There are punishments. The obtained results indicate that respect for the human personality of criminals, which is emphasized in Islamic teachings, has a decisive role in crime prevention based on criminological findings. The present article first explains the key concepts and then examines the basics of respect for the human personality of criminals in Islamic teachings and the components of the prevention approach based on respect for the human personality of the criminal.پیشگیری از جرم روش‌ها و الگوهایی مختلفی دارد که الگوی پیشگیری کرامت‌مدار یکی از آن موارد است. منظور از پیشگیری کرامت‌مدار آن است که در فرایند مواجهه با جرم، شخصیت و کرامت ذاتی مجرم موردتوجه قرار بگیرد. پیشگیری مبتنی بر احترام به شخصیت انسانی مجرم بر این فرض استوار است که جایگاه اجتماعی افراد نقش مؤثری در ارتکاب یا عدم ارتکاب جرم دارد. هدف تحقیق حاضر بررسی نقش احترام به شخصیت انسانی مجرم در پیشگیری از جرم از منظر آموزه‌های اسلامی و دست‌یابی به الگویی مواجهه مؤثر با پدیده مجرمانه و پیشگیری از آن است. تحقیق حاضر در پی ارائه پاسخ به این مسأله است که احترام به شخصیت انسانی مجرم از چه جایگاهی در آموزه‌های اسلامی برخوردار است و این‌ رویکرد چه تأثیری در پیشگیری از جرم دارد. داده‌های تحقیق حاضر از طریق مطالعات کتابخانه‌ای جمع‌آوری و با استفاده از روش تحقیق تحلیلی- توصیفی بر مبنای آموزه‌های اسلامی و جرم‌شناختی موردبررسی قرار گرفته است. یافته‌های پژوهش حکایت از آن دارد که بر اساس آموزه‌های اسلامی، ارتکاب جرم کرامت ذاتی انسان را مختل نمی­سازد و این مسأله دارای مبانی قرآنی، روایی و عقلی است که شامل مؤلفه‌هایی چون تأکید بر پوشیده ماندن برخی جرایم، عفو و اهمال در اعمال برخی مجازات‌ها می‌گردد. نتایج به‌دست‌آمده حکایت از آن دارد که احترام به شخصیت انسانی مجرمان که در آموزه‌های اسلامی مورد تأکید قرارگرفته، بر اساس یافته‌های جرم‌شناختی نیز، نقش تعیین‌کننده‌ای در پیشگیری از جرم دارد. مقاله حاضر ابتدا به تبیین مفاهیم کلیدی و سپس مبانی احترام به شخصیت انسانی مجرمان در آموزه‌های اسلامی و مؤلفه‌های رویکرد پیشگیری مبتنی بر احترام به شخصیت انسانی مجرم را مورد بررسی قرار داده است.
