Pandangan Hukum Islam Tentang Unsur Merugikan Keuangan Negara Dalam Tindak Pidana Korupsi Melalui Tinjauan Yuridis

Abstract

Corruption or it can also be referred to as defilements are types of violations that are compromised by certain laws (Indonesia), but besides that, the existence of corruptors is damaged in world law and even nations that use Islamic law. The research conducted in this article is a qualitative research using literature studies on trusted sources originating from internet journals which are supported by other people's research and discussed using their own language which was developed and supported by several research results. The data collection carried out in this study used observations and searches on the Internet regarding literature studies. The purpose of this research is to find out the elements that are detrimental to state finances from the existence of a criminal act of corruption through a juridical review. The results of the study show that there are many corruption cases that occur in Indonesia involving high-ranking officials who eat away at the rights of citizens and harm this country, because corrupted money can cause and harm this country on the finances that have been provided and made for the community. In this positive law it has been explained that in criminal acts of corruption that have been carried out by these officials, it must be immediately eradicated and dealt with at the root. In traditional Islamic law, it has not been disclosed by legal advisors about degeneration.
