IMPLEMENTASI BANTUAN HUKUM BAGI MASYARAKAT MISKIN (STUDI KASUS DI PENGADILAN AGAMA MATARAM)

Abstract

Purpose of this research are to examine and analyze legislation regulating legal assistance; to examine and analyze the implementation of Act.Number 16 Year 2011 regarding Legal Assistance and all its implementation regulations in the Religion Court of Mataram. This research is empirical legal research/sociological legal reseach (Sosiolegal legal research). Implementation of Act Number. 16 year 2011 regardingt Legal Assistance in the Religioun Court of Mataram not optimal yet, it proved with number of cases handled by the advocates associated with legal assistance in accordance with the terms in Act Number 16 year 2011 only 5 percent. The legal obstacles for legal assistace for the poor i vis dualism and conflict of norm in Act Number. 50 Year 2009 about Religion Court with Act Number. 16 Year 2011 Regardimg Legal Assistance in regulating the authority of legal assistance. Non Yuridical obstacle included lack of socialization of ActNumber. 16 The year 2011 about Legal Assistance, that impact on the "society have lack of knowledge about legal services, lack of knowledge of the institution outside the court; and lack of coordination between agencies that give legal assistance with the court and limited budget in the State Budget for legal assistance in handling a case that give legal assistance up to level of appeal and cassation review.
