Litigious witdrawal in Colombia and its possible exercise in global assignments of rights

Abstract

The transfer of litigious rights has been widely discussed from its initial interpretations to the current Law, beginning with every concept of «litigious right». Added to this instability is the vertiginous development of global transfer of rights, mainly rights that could be considered litigious, which explains why the issue of the right of withdrawal has acquired a greater relevance in recent times. For this reason, this article analyze the assignment of litigious rights, especially in relation to the right of withdrawal in favor of the debtor of an assigned claim.
