A interpretação conforme a constituição e as sentenças manipulativas

Abstract

Este artigo se situa no campo do direito constitucional, mais especificamente na parte relativa às técnicas utilizadas pelo supremo tribunal federal (stf) e pelos demais órgãos do poder judiciário em suas sentenças. O objetivo é demonstrar que o contraponto da interpretação conforme a constituição (sentença interpretativa de constitucionalidade) deve ser a sentença interpretativa de inconstitucionalidade em sentido estrito e não a sentença de inconstitucionalidade parcial sem redução de texto. Tendo por base doutrina e jurisprudência do STF e de tribunais constitucionais europeus, são analisados os fundamentos de dois acórdãos emitidos no âmbito do controle difuso, constatando-se que essas decisões não são de inconstitucionalidade parcial sem redução de texto, mas manipulativas aditivas, ainda que uma delas apenas parcialmente. Conclui-se que os limites entre a função judicial e a legislativa poderão ser melhor avaliados, se a escolha entre interpretações alternativas (interpretação conforme a constituição) deixar de ser confundida com redução, adição ou substituição do conteúdo normativo (sentenças manipulativas).This article is situated in the field of constitutional law, more specifically on the part concerning techniques used by the stf and by other bodies of the judiciary in their decisions. The goal is to demonstrate that the counterpoint of the interpretation according to the constitution (constitutionality interpretative sentence) must be the unconstitutionality interpretative sentence in his strict sense and not the unconstitutional partial sentence without loss of text. Based on doctrine and jurisprudence of the stf and european constitutional courts shall review the basics of two judgments issued under the diffuse control, noting that these decisions are not partially unconstitutional without loss of text, but manipulative addictive, even if one of them only partially. It is concluded that the boundaries between the legislative and judicial function may be better assessed if the choice between alternative interpretations (interpretation according to the constitution) ceases to be confused with reduction, adding or replacing the normative content (manipulative sentences).
