Abstract

This study analyzes the main legal figure used in the detention and deportation of prisoners and inmates to Nazi concentration camps: protective custody. Created at the end of the 19th century, National Socialist criminal law soon rediscovered it as a form of permanent detention outside the judicial system. It was soon used to deport to German concentration camps all those who had fought in the Spanish civil war against the Reich.
