Abstract

One of the objectives of the establishment of Law Number 22 of 2009 concerning Road Traffic and Transportation is to realize safe, safe, orderly, smoothandintegratedtraffic androadtransportation services with other modes of transportation to encourage the national economy, promote public welfare, strengthen national unity and integrity, as well as being able to uphold the dignity of the nation. In an effort to enforce traffic law on the highway, especially in urban areas such as in the city of Bandung against traffic violators on the highway, Electronic-Traffic Law Enforcement (ETLE) has been implemented, which is a system that takes pictures of violations on the highway through CCTV cameras, cameras the scout is connected directly to the TMC. The problems studied are: 1) how is the regulation of E-TLE and its sanctions in Indonesian positive law, 2) how is the implementation of electronic ticketing (ETLE) criminal law enforcement against traffic violators in the city of Bandung, 3) how the Bandung Poltabes policy responds to the obstacles faced in prosecution of e-tickets. This research method uses empirical juridical research. In this study, the authors describe Das Sollen Das Sein or the suitability of law enforcement expectations for traffic violations subject to criminal sanctions based on the provisions of Law Number 22 Year 2009 concerning Road Traffic and Transportation with the reality that occurs in law enforcement against traffic violations. . The results of the study illustrate that the regulation of E-TLE is Article 272 of Law Number 22 of 2009 concerning Traffic and Road Transportation and Government Regulation Number 80 of 2012 concerning Procedures for Inspection of Motorized Vehicles on the Road and Enforcement of Traffic and Road Transportation Violations. The implementation of an electronic ticket (ETLE) for traffic violators in the Bandung City Police jurisdiction has not been effective because the implementation of an electronic ticket (ETLE) has not been in accordance with the expected goals of the E-Ticket program. E-tickets that should be carried out on an electronic basis (without using a ticket) in practice still use a ticket. In addition, there are still many people who do not know about the procedure for resolving cases of traffic violations with E-Tilang so that many people have difficulty when they are going to process the payment of fines or take items that were previously confiscated. Constraints faced in the enforcement of e-ticketing are not yet optimal coordination between the Police, District Courts, District Attorneys and Bank Rakyat Indonesia (BRI) as agencies directly related to the e-ticketing program, lack of socialization to the public so that there are still many people who do not understand E-ticketing. -Tickets, both programs and the flow of implementation, lack of public awareness to learn and find out about the E-Ticket program in the process of resolving traffic violation cases.
