Política y criminalidad en el «nuevo Estado» franquista. la criminalización del «enemigo» en el derecho penal de posguerra

Abstract

The consolidation of Franco's «New State» brought with it the drafting of a doctrine and criminal legislation that allowed it to suppress the political enemies of the dictatorship, as well as to establish control over society. This paper studies the criminalization of social deviancy in the postwar period. Criminalization is the selection of a group of persons, whom the power of the State submits by coercive means. In the «social construction» of crime, the main feature was the categorization of the «other» as a dangerous and harmful enemy both morally, socially and in the common justice system in Spain.
