Las agresiones del desarrollo: pueblos indígenas, normas internacionales e industrias extractivas

Abstract

This article analyzes the strategies used by the network of indigenous rights before the impact of the extractive industries, inside a scheme of development and diffusion of international norms, and the assumption of these norms on the part of the state actors, international organizations and other transnational actors. The article argues that the cases of exploitation of resources in specific communities and its devastating impacts for the cultural and material survival of these communities have served both as sources of information to legitimize the international claims for recognition, and as tools in demanding moral or juridical responsibilities. In spite of the primary interest of the states and companies in the access to the natural resources in the traditional indigenous territories, these activities meet themselves increasingly disciplined by international procedures that limit in certain ways the capacity of action of these actors, and concern the definition of their interests.Este artículo analiza las estrategias empleadas por la red de derechos indígenas ante el impacto de las industrias extractivas dentro de un esquema emergencia y difusión de normas internacionales y de socialización de estas normas por parte de los actores estatales, organizaciones internacionales y otros actores transnacionales. El artículo argumenta que los casos de explotación de recursos en comunidades específicas y sus devastadores impactos para la supervivencia cultural y material de estas comunidades han servido tanto de fuentes de información para legitimar las demandas internacionales de reconocimiento como para exigir responsabilidades morales o jurídicas. A pesar del interés primario de los actores estatales y de las empresas en el acceso a los recursos naturales en los territorios tradicionales indígenas, las actividades extractivas se ven cada vez más disciplinadas por normas internacionales que limitan en cierta manera la capacidad de acción de estos actores, y afectan a la definición de sus intereses.
