Abstract

The article focuses on the importance of patent system to the business strategy in the U.S. It allows firms to exclude competitors and create incentives for innovations to attract customers. Grain Processing decision has decreased the expected value of damages from infringement because it has conferred a free option on the infringer. This free option transfers economic value to the infringer and the economic value away from the patent holder that results to the decrease in economic incentives.
