PERKEMBANGAN PENERAPAN ASAS ITIKAD BAIK DALAM KONTRAK ELEKTRONIK

Abstract

ABSTRAKElectronic Contarct merupakan kontrak yang timbulk akibat kemajuan teknologi dan informasi. Sistem Elektronik; “merupakan serangkaian perangkat dan prosedur elektronik yang berfungsi mempersiapkan, mengumpulkan, mengolah, menganalisis, menyimpan, menampilkan, mengumumkan, mengirimkan, dan/atau menyebarkan informasi elektronik”. Di berlakukanya undang-undang informasi dan transaksi elektronik (UU-ITE), merupakan wujud pemerintah Republik indonesia dalam merespon kemajuan teknologi.Segala macam bentuk perikatan perjanjian termasuk pada kontrak elektronik harus menerapkan dengan itikad baik. Hal iniberdasarkan pada Pasal 1338 Kitab Undang-Undang Hukum Perdata.Adapun keharusan dalam penerapan iktikad baik meliputi sebelum terjadinya kontrak, dan atau saat terjadinya maupaun berlangsungnya kontrak sampai pada setelah kontrak dilakukan.Kata Kunci : Asas Itikad Baik, Kontrak Elektoronik ABSTRACKElectronic Contarct is a contract that arises due to advances in technology and information.
