Cartografía de un principio jurídico: un análisis bibliométrico de la presunción de inocencia en Scopus (1936-2021)

Abstract

El presente estudio tuvo como objetivo analizar el tratamiento epistemológico y la evolución de la presunción de inocencia en la literatura científica para evidenciar la brecha académica existente en su abordaje. Se realizó una revisión bibliográfica con un análisis documental bajo un paradigma positivista y un enfoque cuantitativo. La investigación fue de tipo básico, nivel descriptivo y diseño transversal, utilizando una muestra de 36 artículos de la base de datos Scopus y herramientas bibliométricas como VOSviewer. El análisis bibliométrico reveló un interés científico esporádico y limitado en la presunción de inocencia desde 1936, con Estados Unidos e Inglaterra como los países con mayor producción. Se determinó que el 70 % de los documentos analizados eran artículos y el 55 % pertenecía al área de ciencias sociales. El estudio identificó que la aplicación de la prisión preventiva y la falta de motivación en las resoluciones judiciales son manifestaciones críticas que vulneran este principio, a menudo influenciadas por la presión mediática y política, lo que evidencia una tensión entre la norma y la práctica judicial. Se concluye que existe una notable necesidad académica y científica de profundizar en el estudio de la presunción de inocencia mediante nuevas y diversas problematizaciones, ya que su tratamiento en publicaciones de alto impacto ha sido históricamente insuficiente y poco constante, a pesar de su rol como pilar del Estado de derecho y garantía fundamental del ciudadano.The present study aimed to analyze the epistemological treatment and evolution of the presumption of innocence in scientific literature to highlight the existing academic gap in its study. A bibliographic review was conducted with a documentary analysis under a positivist paradigm and a quantitative approach. The research was basic, descriptive, and cross-sectional, using a sample of 36 articles from the Scopus database and bibliometric tools such as VOSviewer. The bibliometric analysis revealed sporadic and limited scientific interest in the presumption of innocence since 1936, with the United States and England being the countries with the highest output. It was determined that 70% of the analyzed documents were articles and 55% belonged to the social sciences area. The study identified that the application of pre-trial detention and the lack of reasoning in judicial decisions are critical manifestations that violate this principle, often influenced by media and political pressure, highlighting a tension between the norm and judicial practice. It is concluded that there is a significant academic and scientific need to deepen the study of the presumption of innocence through new and diverse problematizations, as its treatment in high-impact publications has been historically insufficient and inconsistent, despite its role as a cornerstone of the rule of law and a fundamental guarantee for citizens.
