Neuroderechos y derechos humanos en la era de la neurotecnología: ¿Regulación necesaria o inevitable?

Abstract

This paper explores the regulatory importance of neurorights based on technological development and the need to establish a balance between scientific and technological innovation and the protection of fundamental human rights. The development of neurotechnologies in the mapping of the brain makes it necessary to observe the responsible and ethical use of these. In Ecuador we will see that, although there are regulations that can provide a close answer to the issue, they do not contemplate some of the assumptions of use of these technologies, so it is essential to develop new regulatory frameworks. The research uses a qualitative, descriptive and exegetical methodology, contrasting legal regulations with the experiences of organizations that already manage these technologies, in order to understand the ethical and legal challenges we face today.En este trabajo se explora la importancia regulatoria de los neuroderechos a partir del desarrollo tecnológico y la necesidad de establecer un equilibrio entre la innovación científica y tecnológica y la protección de los derechos humanos fundamentales. El desarrollo de las neurotecnologías en la cartografía del cerebro hace necesario observar el uso responsable y ético de estas. En el Ecuador veremos que, aunque existen normas que pueden dar una respuesta cercana al tema, estas no contemplan algunos de los supuestos de la aplicación de estas tecnologías, por lo que es esencial desarrollar nuevos marcos regulatorios. En la investigación se ha utilizado una metodología cualitativa descriptiva y exegética, contrastando normativas jurídicas con las experiencias de organizaciones que ya gestionan estas tecnologías, con el fin de comprender los retos éticos y legales que enfrentamos hoy en día.
