Dynamics of Inheritance Law in the Digital Age: Challenges and Solutions

Abstract

Background: With the rapid development of digital technology, the way humans store, manage, and transfer digital assets has changed drastically. However, traditional inheritance law is often unable to handle these realities well, leading to ambiguity and potential conflict among heirs. Objective: This study aims to investigate the dynamics of inheritance law in the digital age, identify the challenges faced, and explore possible solutions. It is intended to provide a better understanding of how inheritance law can evolve in line with the development of information technology.  Method: This research uses a comparative legal analysis approach and case studies against existing legal regulations in various jurisdictions. An interdisciplinary approach is used by involving aspects of information technology, ethics, and public policy. Result: This research results in an in-depth understanding of the challenges of inheritance law in the digital age, including legal vagueness regarding digital inheritance and the potential conflicts that arise. Proposed solutions include legal rule renewal, policy development, and relevant ethical approaches. Conclusion: This study concludes that inheritance law needs to undergo significant adjustments to be able to overcome the challenges that arise along with the development of digital technology. The proposed solutions can help provide a better framework for addressing digital inheritance and contribute to the development of inheritance law in the face of the digital age.
