Abstract

La crisis carcelaria en Ecuador ha alcanzado una dimensión estructural que evidencia la incapacidad del sistema penitenciario para cumplir su finalidad constitucional de rehabilitación social. Este trabajo examina la reinserción laboral postpenitenciaria como eje estratégico para enfrentar dicha crisis desde un enfoque jurídico, socioeconómico y psicosocial. A partir del análisis de la normativa vigente, la política pública y las condiciones institucionales del país, se identifican factores que obstaculizan la rehabilitación efectiva: la fragmentación institucional, la ausencia de programas sostenidos de capacitación y empleo, el estigma social hacia las personas liberadas y la falta de coordinación entre el Estado, el sector privado y la sociedad civil. Se sostiene que la reinserción laboral no constituye un componente accesorio del sistema penitenciario, sino el núcleo de una política pública de seguridad y justicia social. La incorporación laboral de los ex privados de libertad es presentada como una vía concreta para romper el ciclo de exclusión, reincidencia y violencia que sostiene la crisis carcelaria ecuatoriana, así como para transformar la rehabilitación de una promesa jurídica en una realidad efectiva sustentada en trabajo y dignidad.The prison crisis in Ecuador has reached a structural dimension that reveals the penitentiary system’s inability to fulfill its constitutional mandate of social rehabilitation. This paper examines post-prison labor reintegration as a strategic axis to address the crisis from a legal, socioeconomic, and psychosocial perspective. Through an analysis of the current legal framework, public policy, and institutional conditions, it identifies the main obstacles to effective rehabilitation: institutional fragmentation, the absence of sustained employment and training programs, social stigma against formerly incarcerated people, and the lack of coordination among the State, private sector, and civil society. The study argues that labor reintegration should not be treated as an auxiliary component of the penal system, but as the foundation of a public policy for social justice and security. Employment for formerly incarcerated individuals is presented as a concrete path to break the cycle of exclusion, recidivism, and violence that sustains Ecuador’s prison crisis, and as a mechanism to transform rehabilitation from a constitutional ideal into an effective social reality grounded in work and dignity.
