Abstract
Article 15 paragraph (2) letter e of the Law on the Position of a Notary Public gives authority to a Notary to be able to provide legal counseling in making a deed. Legal counseling can be used by a Notary when the parties bring a standard agreement on pre-project selling of apartments to be included in an authentic deed. The form of legal counseling needs to be studied further, because these transactions are very risky for consumers and the position of the developer is more dominant because they are the party that prepares the standard agreement. Thus, the role of a notary is needed in legal counseling. The researcher formulated the following problem: how is the form of Notary legal counseling on buying and selling apartments on a pre-project selling basis as a form of consumer protection? The research method used is normative with library study. The results of the study conclude that notaries can provide legal counseling as a form of consumer protection in pre-project selling model transactions with advice on the existence of standard agreements by filtering and carefully examining draft standard agreements made by developers who function and aim to provide protection to consumers. A standard agreement in which the contents of the clause have already been made in the form of a document in the form, the Notary can provide advice and review the articles that are considered contradictory and provide initials of the contents of the article with the limitation that the Notary still may not side with one of the parties.
