Revisión jurisprudencial de la guarda y custodia compartida e interés del menor : novedades en torno a la futura ley de corresponsabilidad parental

Abstract

La seguridad jurídica en materia de guarda y custodia aconsejan establecer criterios comunes de actuación. El objetivo es la tutela del supremo interés del menor, principio rector en esta materia. La STS 29 abril 2013 (EDJ 2013/58481) ha establecido como doctrina jurisprudencial que la guarda y custodia compartida ha de considerarse como el régimen normal y más conveniente para el menor.Legal certainty regarding custody advice establish common performance criteria.
