Abstract

International free markets often create conflicts between countries as a result of their competition. As occurred in 2013, Europe Union (EU) issued an Anti-Dumping Import Duty policy on biodiesel products from Indonesia. Indonesia took legal action against EU policy by filing a lawsuit against EU to the World Trade Organization (WTO) through its special agency, the Dispute Settlement Body (DSB). With this lawsuit, Indonesia won the dispute and forced EU to revoke the policy. This study finds that the failure of EU to show its accusations, stating that Indonesia is conducting dumping, is a piece of clear evidence that EU is carrying out covert protection of its domestic market. This research is normative legal research that examines in detail library materials such as books, scientific journals, laws, provisions in the 1947 GATT, and other information related to this research. This study argues that EU policy aims to isolate and exclude palm oil from the renewable energy sector for the benefit of other, less competitive vegetable oils produced in EU member countries.
