Obstetric Violence: Emergency for Legislative Regulation in Brazil

Abstract

This study aimed to identify existing means of protecting women and investigate the real need to regulate the struggle against obstetric violence in Brazil. Furthermore, it sought to identify the forms of violence against women and the existing national and international protective measures. To this end, bibliographical, doctrinal and jurisprudential research was carried out. The study demonstrated the importance of specific legislation that deals with obstetric violence, which defines a clear concept of the issue and which women are aware of, so that they can defend themselves. Such legislation is also fundamental for the development and implementation of measures to be taken in the event of obstetric violence by public or private agents. It is concluded that there is an urgent need to enact such legislation to protect women to guarantee their reproductive rights.
