Abstract
This paper intends to examine the shortcoming of the current formulation of the right to a healthy environment in the Chilean Constitution and, based on this analysis, to make a proposal that would cover the denomination of the right, its content and the definition of its scope. This latter analysis would be in light of legal doctrine, case law and the international human right law. The paper concludes with a proposal of a new provision that would regulate the right to a healthy, sound and adequate environment, ecologically balanced, suitable for the development and welfare of people and communities.
