EL CONCEPTO DE IMPRUDENCIA Y SU UBICACIÓN SISTEMÁTICA

Abstract

With this publication it is sought to need the correct notion of recklessness, realizing a brief analysis of more important concepts formulated on the part of the predecessors of the schools of the penal thought. This investigation took as a foundation the importance of the penal norm designed as instrument of normative motivation, which drove to establish the need to admit the normative nature of the recklessness of the one that is presupposed the injury of the norm of care and, as necessary not sufficient element, the infraction of the duty of care. The type of investigation used for this work implied the use of the dogmatic method.
