Derecho y Justicia no androcéntricos Law and non androcentric justice

Abstract

Resumen En este artículo describo algunas de las relaciones entre la ética del cuidado y las teorías jurídicas feministas. Las teorías jurídicas feministas han buscado una fundamentación para desarrollar un concepto de justicia no androcéntrico. Una de ellas ha sido el debate jurídico feminista sobre la ética del cuidado y sus aplicaciones al mundo de los derechos de las mu-jeres. El análisis de diversas autoras que abordan la relación entre la justicia y el cuidado nos muestra los peligros de utilizar jurídicamente un concepto de cuidado descontextuali-zado de las relaciones de poder entre los sexos. Por otra parte, una justicia no androcéntri-ca requiere, desde una perspectiva feminista, incluir las relaciones de cuidado en el ámbito de los derechos. Feminist legal theories have been searching a basis for a non androcentric concept of justice. One of these has been the feminist legal debate on the ethics of care and its appli-cations to the world of women's rights. The analysis of various authors who dealt with jus-tice and care shows the dangers of using a concept of care without an análisis of power re-lations between the sexes. Moreover, non-androcentric justice requires, from a feminist perspective, including caring relationships in the field of rights.
