Abstract

This paper reports on what is believed to be the first successful textile infringement case this century, concerning the imitation of a Designers Guild textile design by another company, and argues that this result will have significant implications for the apparel industry, as copyright on textile design should offer far more protection in the future. It presents the details of the case, and future implications for the industry. The paper concludes by advising all designers to keep in-depth records of their story boards, art work and the original inspiration for the design.
